Members Present:  Bruce Healey, Chair; Ron Williams, Travis Dezotell, Russell Smith, Members; Deane Geddes, Alternate; Rachel Ruppel, Advisor; Jim Powell, ex-officio member.

Mr. Healey called the meeting to order at 7:01 p.m.

Mr. Healey appointed Mr. Geddes as a voting member for this meeting.

PUBLIC HEARING - Proposed Amendments to the Newbury Zoning Ordinance
Mr. Healey reviewed the public hearing process before reading the Public Notice into the record as follows:

NEWBURY PLANNING BOARD NOTICE OF PUBLIC HEARING  
Notice is hereby given that the Newbury Planning Board will conduct a public hearing on Tuesday, February 5, 2013 at 7:00 P.M. in the Newbury Town Office Building, Route 103, Newbury, N.H. to receive public input on amendments to the Newbury Zoning Ordinance proposed by the Planning Board. The proposed amendments to be discussed at this public hearing are summarized below. Copies of the full text of the amendments proposed by the Planning Board are available in the Town Office Building, Route 103, Newbury, NH.
2013 AMENDMENTS TO THE NEWBURY ZONING ORDINANCE PROPOSED BY THE NEWBURY PLANNING BOARD
The amendments to the Newbury Zoning Ordinance proposed by the Newbury Planning Board to be discussed at the January 15, 2013 public hearing are outlined below. PLANNING BOARD PROPOSED AMENDMENT NO. 1: The Planning Board’s Amendment No. 1 proposes to amend Section 2.58 Steep Slopes to clarify the definition of steep slopes.
PLANNING BOARD PROPOSED AMENDMENT NO. 2: The Planning Board’s Amendment No. 2 proposes to amend ARTICLE XXI: Stormwater Management, Section 21.2 to specify that Article XXI applies to erosion control and stormwater management systems required by the provisions of the Shore Land Overlay District.

Mr. Healey noted that there were two typographical errors in the Public Notice: the date of “January 15, 2013” should read “February 5, 2013”; and, “Section 2.58” should read “Section 2.146”. He requested that the Board accept the corrected Notice. It was the consensus of the Board to accept the corrected Notice.  

Mr. Powell asked how those two errors occurred. Ms. Ruppel said the “Section 2.58” was a typing error and the incorrect date was a typing error on the part of the Land Use Coordinator.

There being no further discussion, Mr. Healey noted that, since there was no public present, the hearing would be suspended for 30 minutes, per the Rules of Procedure, to accommodate any late-arriving members of the public.

General discussion followed regarding steep slopes and the calculations used for determining same.

The Board discussed plans for upcoming work on the Planning Board regulations. Ms. Ruppel said the focus will be on clarifying several areas of the site plan review regulations including the following: (1) determining when an individual must return to the Planning Board for a site plan review because there has been a change of use; (2) when is a change of use an actual change and when should it be considered an amendment to the original site plan review; and, (3) the bonding requirements for subdivisions.   

Ms. Ruppel announced that the State Office of Energy & Planning (OEP) has scheduled a conference on May 11, 2013. Details on the planning and zoning topics will follow.

At 7:30 p.m., Mr. Healey re-opened the public hearing.
There being no further discussion from the Board, Mr. Healey opened the hearing to public.
There being no public present, Mr. Healey closed the public portion of the meeting.

Mr. Healey called for a vote.

Mr. Dezotell made a motion to approve Amendment No.1 and place it on the 2013 ballot. Mr. Williams seconded the motion.
Mr. Healey called for a Roll Call vote.
In Favor: Mr. Geddes, Mr. Smith, Mr. Williams, Mr. Dezotell, Mr. Healey
Opposed: None

Mr. Geddes made a motion to approve Amendment No. 2 and place it on the 2013 ballot. Mr. Smith seconded the motion.
Mr. Healey called for a Roll Call vote.
In Favor: Mr. Geddes, Mr. Smith, Mr. Williams, Mr. Dezotell, Mr. Healey
Opposed: None

Mr. Powell asked Mr. Healey to ensure that the Town Administrator has the corrected Amendment language. Mr. Healey said Ms. Ruppel sent the corrected Amendments to the Town Clerk.  

Mr. Dezotell made a motion to adjourn. Mr. Smith seconded the motion. All in favor.

Meeting adjourned at 7:35 p.m.
